Special counsel Jack Smith has urgently requested the U.S. Supreme Court to swiftly rule on whether former President Donald Trump can be prosecuted for alleged efforts to overturn the 2020 election.
The trial, set for March 4, 2024, faces potential delays if the court doesn’t act promptly. Trump, who aims to reverse a federal judge’s ruling allowing the case to proceed, criticized the move, while Smith seeks to bypass the appeals court and have the Supreme Court directly address crucial questions regarding presidential immunity from prosecution.
The justices have ordered Trump’s lawyers to respond by Dec. 20. This is the second case regarding President Trump before SCOTUS.
On December 19, 2023, Colorado Supreme Court bumped President Trump off the ballot while on December 18, 2023, Mark Meadows could not move his case out of a state court.
