Bailey, who had no direct connection to Trump’s current legal cases, informed NBC New York that he offered unsolicited advice to Engoron about the case, aiming to ensure the judge made the correct decision. Trump’s lawyers argue that this conversation undermines the court’s impartiality, as neither the defendants nor the Attorney General were informed of the communication.
They also claim that Bailey is not an impartial expert due to his vested interest, given his previous involvement in a lawsuit against Trump. Additionally, a state judicial conduct investigation is underway regarding the conversation. Engoron has denied that Bailey’s comments influenced his decision. Previously, in February, Engoron ordered Trump, his companies, and fellow defendants to pay nearly $364 million over business practices, with Trump and his organizations specifically penalized $354 million, a decision which Trump has appealed.
Engoron also mandated that a court-appointed independent monitor continue overseeing the Trump Organization’s financial activities for at least three years.
