Ruling Against Indefinite Detention for Young Murderers Sparks Legal Debate

The recent ruling by High Court judges in the case of Jesse Quaye has ignited a legal discourse surrounding the compatibility of indefinite detention at Her Majesty’s Pleasure (DHMP) with the rights of young offenders under the European Convention on Human Rights. Jesse Quaye, convicted of murder at 18 for an offense committed at 17, challenged the legality of DHMP sentences under the Police, Crime, Sentencing and Courts Act 2022. The judges underscored the importance of considering the offender’s age at the time of the offense, emphasizing that sentencing should reflect the principle of proportionality. They concluded that the differential treatment of offenders sentenced to DHMP at 18 is unjustifiable, leading to a declaration of incompatibility with articles 5 and 14 of the European Convention.
