Supreme Court Sets March Argument Session for Pivotal Abortion Pill Case

The Supreme Court is poised to delve into the abortion debate once again, scheduling oral arguments on March 26th for the case of Food and Drug Administration v. Alliance for Hippocratic Medicine and Danco Laboratories v. Alliance for Hippocratic Medicine. This landmark case involves the approval and access to the medication abortion drug, mifepristone, sparking significant controversy within the medical community. This marks the first time the Supreme Court addresses abortion since the pivotal 2022 ruling in Dobbs v. Jackson Women’s Health Organization.

The case challenges the FDA’s approval of mifepristone, a crucial element in early-stage pregnancy termination, with opponents arguing its safety. The 5th Circuit’s decision to uphold the FDA’s initial approval but restrict later actions has heightened the stakes. Despite these legal wrangles, a temporary order issued by the Supreme Court in 2023 maintains widespread availability of the drug.

Aside from the abortion pill case, the March calendar includes Murthy v. Missouri, a case examining government communication with social media companies on content moderation policies. This raises questions about the First Amendment and the government’s role in shaping private companies’ decisions.

The oral arguments will also touch on issues ranging from the National Rifle Association’s freedom of speech, drug-trafficking prosecutions, bankruptcy claims, First Amendment retaliation, water disputes, Native American health care funding, to corporate assets in federal estate tax calculations.
