Unveiling the Struggles: Lawyers Battle Barriers to Connect with Incarcerated Clients

Prison lawyers across the nation are facing staggering challenges in accessing their clients, hindering the legal process and contributing to court backlogs. The Association of Prison Lawyers recently published a report exposing the daunting obstacles legal practitioners encounter when attempting to communicate with their clients behind bars. In 78 documented instances, spanning 46 prisons, lawyers grappled with issues such as unavailability of video-link facilities, prolonged appointment wait times, and ineffective in-person visits.

The report highlights one lawyer’s request for a video-link to meet their juvenile client two months before a parole hearing, only to be informed that the earliest available slot was two days after the crucial hearing. Shockingly, in 34 cases, practitioners were informed that there were no video-link facilities for solicitors, while 25 examples revealed unacceptably long waits for appointments. In 13 instances, in-person appointments were severely restricted, and six cases reported legal visits deemed ‘ineffective’ due to various issues.

Dr. Laura Janes, analyzing the data for the Association, emphasized that the report provides only a glimpse into the widespread delays and inadequate facilities. Law Society President Nick Emmerson underscored the critical need for lawyers to have timely access to their incarcerated clients, emphasizing the impact on court proceedings and the potential for increased costs and case delays.

The report recommends urgent implementation of confidential video links and in-person visits within a reasonable timeframe at every prison, prioritizing legal visits. This comprehensive approach aims to address the serious delays and lack of appropriate facilities experienced by lawyers representing clients in custodial institutions.

Justice Minister Mike Freer received the report last Monday, prompting a call for immediate action. The Law Society and prison officials are urged to collaborate to ensure that legal practitioners can effectively represent their clients, safeguarding the integrity of the justice system.
