In a pivotal decision, the Supreme Court recently refrained from intervening in a heated battle concerning race and redistricting in Michigan. The state’s independent redistricting commission sought to delay a lower court’s ruling, mandating a redraw of state legislative maps for the Detroit area due to alleged over-reliance on race.

The dispute arose when the commission, comprising randomly selected Democrats, Republicans, and independents, submitted a revised redistricting plan. This plan significantly reduced the number of majority-Black state legislative districts in the Detroit area, sparking a legal challenge from 19 Black Detroit residents in March 2022.
The residents contended that seven state senate districts and ten house districts with Black voting-age populations below 50% violated the Constitution and the federal Voting Rights Act. A federal district court, in a decisive move, sided largely with the residents, asserting that the commission had excessively used race in drawing Detroit-area districts.
The court rejected the commission’s argument that creating districts with larger Black voting-age populations would violate the Voting Rights Act by “packing” Black voters into specific districts. Despite the Supreme Court acknowledging the possibility of such a claim in 1986, the court emphasized that the commission lacked good reason to believe Black voters could elect candidates of their choice in districts with 35 to 45% Black voting-age populations.
In response, the court prohibited the use of the commission’s map for elections, ordering the submission of new plans by Feb. 2, aiming for approval by late March. The commission, fearing disruption to state-law deadlines for the August 2024 primary elections, appealed to the Supreme Court to put the lower court’s ruling on hold.
The Supreme Court’s decision not to intervene aligns with the residents’ plea to address what they consider “one of the most egregious racial gerrymanders in recent history.” Consequently, the lower court proceedings will proceed, bringing to light the intricacies of redistricting and its implications on voting rights.
