The case involves a commercial truck driver, Douglas Horn, who claims that the CBD product led to his job loss due to a failed drug test. The pivotal question is whether economic harm resulting from personal injuries can be considered an injury to “business or property” under RICO.

Dixie X, marketed as a revolutionary hemp-powered wellness solution, faces scrutiny as Horn alleges he was misled about the THC content despite thorough reviews. His subsequent job loss prompted a lawsuit invoking RICO, alleging the company’s involvement in federal mail and wire fraud that led to the loss of his salary. The district court dismissed Horn’s RICO claim, stating that RICO does not cover personal injury harms. However, the U.S. Court of Appeals for the 2nd Circuit disagreed, emphasizing RICO’s intent to address economic harm from corrupt activities.

Now, in Medical Marijuana, Inc. v. Horn, the Supreme Court is asked to review the 2nd Circuit’s decision. The company contends that economic harm from personal injuries doesn’t fall under RICO’s purview, highlighting the potential consequences for civil RICO claims if personal injuries are deemed sufficient.
