Empowering Justice: Legal Professionals Now Eligible for Expenses in the QLR Scheme

In a monumental move towards protecting victims of domestic abuse, the innovative Qualified Legal Representative (QLR) scheme has been introduced, reshaping courtroom dynamics. As part of the landmark Domestic Abuse Act 2021, this scheme prohibits abusers from cross-examining their victims in family and civil court. The Ministry of Justice reports a growing participation of legal professionals in the QLR scheme, prompting the government to enhance incentives.

To attract more lawyers, the government now allows the reimbursement of expenses. Lawyers engaged in cross-examination can claim up to £180 for travel, £100 per night for hotel stays, and £21 per night for food expenses. Additional claims of £40 per day for expenditures like car parking or toll charges are also permitted. While this is a positive step, critics argue that fees remain insufficient, hinging on legal aid rates frozen since 1996.

Law Society president Nick Emmerson commends the progress but calls for ongoing improvements to boost solicitor participation. The government’s commitment to enhancing the QLR scheme’s financial attractiveness is seen as a move in the right direction. Minister for victims and safeguarding, Laura Farris, emphasizes that these changes aim to incentivize legal professionals, ensuring victims feel secure in their pursuit of justice.

Domestic abuse commissioner Nicole Jacobs, a vocal advocate for increased funding in the family court, expresses delight in the government’s commitment to the cause. She hopes for a surge in participation following the announced enhancements, signaling a positive shift in the family court’s response to domestic abuse.

The new expenses policy, effective from January 2nd, marks a significant stride in the legal landscape, fostering an environment where legal professionals are motivated to actively contribute to the QLR scheme, ultimately prioritizing the safety and well-being of domestic abuse victims.
