Conservative Judicial Activist’s Firm Receives $21 Million – Unraveling the Financial Web

In a recent tax filing, it was revealed that Leonard Leo’s consulting firm received a substantial $21 million in 2022 from The 85 Fund, a key player in Leo’s nonprofit network. The 85 Fund is currently under investigation for potential tax law violations by the D.C. attorney general. This development coincides with increased congressional scrutiny of Leo’s role in advancing the conservative legal movement, including his alleged involvement in arranging gifts for Supreme Court justices.

The tax filing, obtained by watchdog group Accountable.US, sheds light on the intricate financial dealings within Leo’s network. The filing states that The 85 Fund engaged in activities to educate the public on constitutionalism, limited government, religious liberty, the role of the courts, education policies, and election reforms. Notably, CRC Advisors, where Leo serves as chairman, emerged as the highest-paid contractor for The 85 Fund.

Leo’s network came under investigation following a complaint filed by a progressive watchdog group, prompting the D.C. attorney general and the IRS to scrutinize the substantial payments made to CRC Advisors. The investigation seeks to determine the nature of services provided and whether Leo violated laws against using charities for personal gain.

Leo’s influence extends beyond The 85 Fund, with the Concord Fund (Judicial Crisis Network) paying approximately $3.8 million to his firm. The filing also unveils significant contributions to Donors Trust, a prominent conservative “dark money” entity, highlighting Leo’s considerable sway over this influential group. In 2022, Donors Trust contributed over $4 million to the Federalist Society, where Leo is co-chairman.

Leo’s network’s financial intricacies raise questions about transparency, accountability, and potential conflicts of interest. As legal professionals, understanding these complexities is crucial for navigating the evolving landscape of conservative legal activism.
